A rental contract in Italy is not just about the flat. A registered contratto di locazione is what lets you claim residenza, register with the health service and renew a permesso di soggiorno, so an unregistered handshake deal costs far more than it saves.

The law requires the contract to be registered with the Agenzia delle Entrate within 30 days of signing. A contract that is never registered is legally void, which leaves you with no protection over the deposit, the notice period or the rent itself.

    4+4 is the standard free-market lease. 3+2 uses a locally capped rent and gives the landlord a tax break. Transitorio runs 1 to 18 months and needs a documented reason; a separate student contract exists in university cities.

    The landlord must supply an Attestato di Prestazione Energetica. Its absence is a warning sign about how the rest of the paperwork will be handled.

Registration carries a 2% tax on the annual rent, split equally between landlord and tenant, unless the landlord opts for cedolare secca — a flat tax that replaces it. Under cedolare secca you pay no registration tax and the rent cannot be raised by the annual ISTAT index, so it is worth asking whether the landlord has chosen it.
